Last updated: 11 October 2026
SpineSway ("we", "us", "our") operates spinesway.com. This policy explains who owns the content on spinesway.com, how to report content you believe infringes your copyright, and what happens next. It applies to our website, our product listings, our social media accounts, our emails and any other material we publish.
SECTION 1 - OUR INTELLECTUAL PROPERTY
All content on this website is owned by SpineSway or licensed to us. This includes product photography, lifestyle imagery, illustrations, infographics, video, product descriptions, page copy, customer review layouts, the SpineSway name and logo, product names such as Triple Fusion, ThermaFusion and Quad Fusion, and the design, selection and arrangement of the site as a whole.
This content is protected by the Copyright, Designs and Patents Act 1988 (United Kingdom), the Trade Marks Act 1994, the United States Copyright Act including the Digital Millennium Copyright Act (DMCA), and equivalent laws in other countries.
You may not copy, reproduce, download, scrape, republish, distribute, sell, adapt or create derivative works from any of our content without our prior written permission. This includes copying our product images, descriptions or page layouts for use on another store, marketplace listing, advertisement or social media account. Unauthorised use of our content may result in a takedown notice to the hosting platform, a claim for damages, or both.
SECTION 2 - REPORTING COPYRIGHT INFRINGEMENT
We respect the intellectual property of others and expect the same in return. If you believe that content on spinesway.com infringes a copyright you own or are authorised to act for, please send a written notice to our designated copyright agent at support@spinesway.com with "Copyright notice" in the subject line.
To be valid, your notice must include all of the following:
1. Your full name, postal address, telephone number and email address.
2. Identification of the copyrighted work you claim has been infringed, or a representative list if there are several.
3. The exact URL or location on our site of the material you claim is infringing, with enough detail for us to find it.
4. A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent or the law.
5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.
6. Your physical or electronic signature.
Notices that are incomplete may not be acted on. We will acknowledge valid notices, review them, and where appropriate remove or disable access to the material in question. We may forward a copy of your notice, including your contact details, to the person who posted the material.
SECTION 3 - COUNTER-NOTICE
If material you posted or that relates to you has been removed in response to a notice and you believe this was a mistake or a misidentification, you may send a counter-notice to support@spinesway.com with "Copyright counter-notice" in the subject line.
Your counter-notice must include:
1. Your full name, postal address, telephone number and email address.
2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification.
4. A statement that you consent to the jurisdiction of the courts of England and Wales, or if you are in the United States, the federal district court for your address, and that you will accept service of process from the person who submitted the original notice.
5. Your physical or electronic signature.
On receipt of a valid counter-notice we will forward it to the original complainant. If they do not notify us within 10 business days that they have started court proceedings, we may restore the material within 10 to 14 business days.
SECTION 4 - FALSE OR BAD FAITH NOTICES
Knowingly submitting a false notice or counter-notice is unlawful. Under section 512(f) of the DMCA, anyone who knowingly misrepresents that material is infringing, or was removed by mistake, may be liable for damages, including legal costs, suffered by the affected party. We treat notices sent to interfere with a competitor's listings as bad faith and reserve the right to pursue every remedy available to us.
SECTION 5 - REPEAT INFRINGERS
We reserve the right to remove content from, suspend or permanently block any customer account, reviewer or other user who is found to repeatedly infringe the intellectual property rights of SpineSway or of others.
SECTION 6 - PERMITTED USE
Brief quotations from our site for the purposes of non-commercial criticism, review, news reporting or private study may be permitted under the fair dealing provisions of UK law or fair use under US law, provided the source is clearly credited as SpineSway with a link to spinesway.com and the use does not misrepresent us or our products. Journalists, bloggers and reviewers who would like to use our images are welcome to ask: email support@spinesway.com and we will usually say yes.
Anything beyond this, in particular using our photography or copy in a competing product listing, advertisement or store, is not permitted.
SECTION 7 - CUSTOMER REVIEWS AND SUBMITTED CONTENT
When you submit a review, photo, video or other content to SpineSway you confirm that you own it or have permission to share it, and you grant us the licence set out in our Terms of Service. You must not submit content that infringes anyone else's copyright, trade mark, privacy or other rights. We may remove any submitted content that we believe does.
SECTION 8 - TRADE MARKS
SpineSway and the SpineSway logo are trade marks of SpineSway. You may not use them, or anything confusingly similar, in any store name, domain name, advertisement, listing or social media account without our written permission. Shopify is a trade mark of Shopify Inc. All other marks are the property of their respective owners.
